General

Products manufactured by Servologic GmbH are supplied solely in accordance with the following General Terms and Conditions, insofar as no other written agreement has been made.

Orders

Orders shall be accepted via the web shop, by email, fax, letter or telephone. The contract of sale shall come into being upon shipment of the goods. The prices cited in our offers are subject to change without notice. They include the valid legal rate of valued added tax. In all cases, the prices valid at the time of ordering shall apply.

Delivery

Goods held in stock are supplied within 2-3 working days. Goods not held in stock are usually supplied within 10 working days (subject to availability). We are entitled to deliver partial orders where reasonable. If goods are returned (because of non-acceptance) for reasons not covered by guarantee, the goods shall be transported at the expense and risk of the purchaser. The costs of delivery and/or settlement shall be charged to the purchaser.

Shipping

The goods will be shipped immediately upon receipt of payment. Within Germany: the goods are transported by DHL (formerly Deutsche Post AG). This has the advantage that if you are absent at the time of delivery you can collect the goods directly from your DHL branch or post office - even on a Saturday! All packages are insured. In each case, the postage costs are calculated automatically. For orders above EUR 100.00 in value, no charges are made for postage within Germany.

Other countries: in the case of deliveries to countries within the European Union (EU) the valid rate of value added tax (VAT) in the Federal Republic of Germany shall apply, unless the purchaser produces a VAT registration number. In the case of orders from outside the EU, we deduct from our prices the amount calculated for German VAT. The customer is responsible for paying the usual rate of import duty.

Payment

The purchaser has the choice between several different methods of payment. If payment is delayed, we are entitled to charge interest at a rate of 5 percentage points above the valid basic rate of interest set by the European Central Bank. In the case of payment by cash on delivery, a c.o.d. charge of EUR 3.60 is payable. DHL also charges an additional postal money order fee of EUR 2.00. In the case of payment via foreign banks, a surcharge is payable to the shop operator to cover bank charges - currently EUR 5.00. Our bank details:

Return privilege and return shipping

The purchaser has the right to return the ordered goods and to have the purchase price refunded without stating reasons within a period of fourteen days. To adhere to this time limit, the purchaser is obliged to return the goods to Servologic GmbH within the time limit. The goods must be unopened, unused and in perfect condition. The purchaser shall bear the costs of returning the goods insofar as the value of the order was less than EUR 100.00. In cases of orders to a value higher than EUR 100.00, half of the postage costs shall be refunded. Before the goods are returned, an RMA number must be obtained. You will receive this RMA number from us without delay. This number must be written clearly on the returned package. The original packaging must not be covered or written on. Please note that we cannot accept packages for which payment has not been made or that do not bear the RMA number. The return privilege does not apply to goods specially made to order.

Retention of ownership

Until payment has been made in full, the goods shall remain the property of Servologic GmbH.

Complaints

Visible defects must be reported to us in writing within 7 calendar days after receipt of the goods. The date of the postmark is decisive.

Place of jurisdiction

The place of jurisdiction is Dresden. The law of the Federal Republic of Germany shall apply. This applies even if the purchaser is resident or has his usual abode outside the Federal Republic of Germany and/or the goods were delivered to a place outside the Federal Republic of Germany.

Texts and images on our website are protected by copyright and may only be used for private purposes. Their commercial use without the written consent of Servologic GmbH is strictly prohibited.

Final clauses

Should any of the above clauses be ineffective or incomplete, all other clauses shall retain their validity. The ineffective or incomplete clause shall be replaced by an agreement that most closely conforms to the meaning and/or commercial purpose of the clause in question. Should this not be possible, it shall be replaced by the relevant legal provisions.
